Sweet Sprinkles Terms & Conditions

By placing an order with Sweet Sprinkles, you agree to these Terms and Conditions. Please read them carefully before ordering.

2. Ordering & Payment

2.1 Advance Orders

  • All orders must be placed in advance with minimum [2 days] notice
  • Orders are confirmed only after payment is received and you receive an order confirmation email
  • We reserve the right to decline orders if we cannot meet your delivery requirements

2.2 Payment

  • Payment must be made in full at the time of ordering
  • We accept:
    - Credit/Debit Cards via Shop Pay (Visa, Mastercard, Amex)
    - Bank Transfer (contact us for details)
  • All prices are in Australian Dollars (AUD) and currently donot include GST 

2.3 Pricing

  • Prices are subject to change without notice
  • The price charged will be the price displayed at the time you place your order
  • We reserve the right to correct pricing errors

3. Product Information

3.1 Descriptions

  • We make every effort to accurately describe our products
  • Actual products may vary slightly from images due to the handmade nature of baked goods
  • Weights and sizes are approximate

3.2 Ingredients & Allergens

  • Full ingredient lists are available on request
  • Our kitchen handles common allergens including wheat, eggs, dairy, nuts, legumes like peanuts and soy
  • We cannot guarantee products are allergen-free even when not listed as an ingredient
  • It is your responsibility to inform us of any allergies or dietary requirements before ordering

3.3 Food Safety

  • All products are prepared in accordance with the Food Act 1984 (Vic) and Australian food safety standards
  • Products should be consumed by the date specified or within 2-3 days of delivery
  • Store products as instructed to maintain quality and safety

4. Delivery

4.1 Delivery Areas

  • We deliver throughout Werribee and surrounding areas within a 150km radius.
  • Delivery fees are calculated based on distance and displayed at checkout

4.2 Delivery Times

  • You must select a delivery date and time window when ordering
  • We will make reasonable efforts to deliver within your chosen window
  • Delivery times are estimates and may be affected by traffic or unforeseen circumstances

4.3 Failed Delivery

  • You must provide accurate delivery details including contact information
  • If delivery cannot be completed due to incorrect address or unavailability:
    • We will attempt to contact you
    • Redelivery fees may apply
    • No refund will be provided for perishable goods that cannot be redelivered
  • Products left unattended at your request are your responsibility once delivered

4.4 Inspection on Delivery

  • Please inspect your order upon delivery
  • Report any issues within 24 hours with photographic evidence

5. Cancellations & Refunds

Summary:

  • Cancellations accepted up to 48 hours before delivery for full refund
  • Consumer guarantee rights apply under Australian Consumer Law
  • Change of mind refunds not available once production has commenced

6. Custom Orders & Special Requests

6.1 Custom Designs

  • Custom designs require approval before production
  • We will provide a design consultation via email
  • Changes cannot be made once production begins

6.2 Dietary Modifications

  • We can accommodate some dietary requirements with advance notice
  • Additional fees may apply for specialty ingredients
  • We cannot guarantee complete allergen elimination due to shared kitchen equipment

7. Intellectual Property

  • All content on our website including images, text, and designs is owned by Sweet Sprinkles or licensed to us
  • You may not reproduce, distribute, or use our content without written permission
  • Photos of our products may be shared on social media with appropriate credit

8. Liability

8.1 Our Liability Under Australian Consumer Law, we provide consumer guarantees that cannot be excluded. Subject to these guarantees:

  • Our liability is limited to the cost of the products purchased
  • We are not liable for indirect or consequential losses
  • We are not liable for allergic reactions if you did not disclose allergies or dietary requirements

8.2 Your Responsibilities You are responsible for:

  • Providing accurate order and delivery information
  • Disclosing allergies and dietary requirements
  • Storing products correctly after delivery
  • Supervising consumption by children

9. Privacy & Data

  • We collect and use your personal information in accordance with the Privacy Act 1988 (Cth)
  • Your information is used to process orders and communicate with you
  • We do not sell or share your information with third parties except as necessary to fulfill orders (e.g., delivery services)

10. Force Majeure

We are not liable for failure to fulfill orders due to circumstances beyond our reasonable control including:

  • Natural disasters, extreme weather
  • Power outages, equipment failure
  • Supplier issues, ingredient unavailability
  • Public health emergencies, government restrictions

In such cases, we will provide a full refund or reschedule delivery by mutual agreement.

These Terms and Conditions are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the Victorian courts.
